Conditions of entry

Entry Restrictions | Open only to Australian residents aged 18 or over and Australian Residents aged 16 or 17 years who have obtained the consent of their parent or legal guardian to enter this Competition, except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies or participating stores associated with this competition. |
Competition Period | 12.01am (AEST) on 01/07/2024 to 11.59pm (AEST) on 31/08/2024. |
Entry Method | To receive one (1) entry into the Competition, entrants must, during the Competition Period: a) make a mini wax statue using only Babybel wax from any Babybel cheese product: b) Send a photo of your creation to @babybelaunz on Instagram; i) a photo and/or video of your mini wax statue; and ii) a short statement confirming that you give your permission for us to share the photo and/or video of your mini wax statue on our social media, wall of fame and for any other marketing purposes. |
Judging Dates | Judging will be conducted on the 2nd – 4th September, 2024 |
Prize Winner Determination | This Competition is a game of skill, and chance plays no part in determining the winners. All entries will be judged individually on their merits based on the Judging Criteria. Most creative wax statue, in concept and execution that heroes our wax as judged by our appointed panel. Judging Criteria – Judges shall assess the entrants using the following metrics: creativity, in concept and execution and innovative use of wax This list is non-exhaustive. |
Prize Details | 1st prize AU$1500 Westfield voucher and the winning statue that will be brought to life and displayed in Westfield Bondi, 2nd Prize AU$1000 Westfield voucher and 3rd Prize AU$500 Westfield voucher. All other selected entries will be featured on our social media channels and on the Wall of Fame alongside the winning wax statue. If a Winner is under 18 years of age, the Prize will be awarded to the parent or legal guardian of the Winner. |
Prize Pool | The total prize pool is valued at AU$3,000.00 (incl GST). |
Entry Limits | Entrants may enter as many times as they wish, except that entries are limited to one (1) entry per person per day. |
Winner Notification and Publication | The winners will be notified by writing, through a message on Instagram on the 5th September, 2024. The winners will have their name and state/territory of residence published on the Promoter’s Facebook page on 7th September for a period of 28 days. |
1 – Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
1 – Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
2 – The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise
3 – The prize is as stated in the Prize Details.
4 – The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published
5 – Each entry must be the entrant’s original work. By entering this competition entrants:
(a) consent to the Promoter making copies of or publishing the whole or any part of their entry and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes;
(b)grant the Promoter a world-wide, royalty free, perpetual, irrevocable, transferrable licence (with a right to sublicense) to use their entry submitted as part of this competition for any purpose;
(c) permit the Promoter to edit, adapt and alter their entry for inclusion on any of their social media pages or other marketing materials;
(d) acknowledge that their entry and their name may be made publicly available by the Promoter (in its absolute discretion) and will be accessible to the general public to view;
(e) represent and warrant that:
(i) they own all rights (including intellectual property rights) or otherwise have the right to grant the licences described above in respect of each entry submitted by them into this competition, that no rights have been granted to any third party in respect of each such entry which would prevent the entry being used as contemplated by this competition, and that the use by the Promoter of any such entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and
defamation);
(ii) any person featured in any photograph or video has consented to the entrant submitting that photograph or video into this competition;
(iii)all persons appearing in any photograph or video are 18 years of age or older or, if any person is under 18 years of age, that their parent’s or guardian’s consent has been provided;
(iv)their entry does not include any content that contravenes any law, infringes the rights of any third party, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity, malice or which may be defamatory or in contempt of court; and
(v) their entry contains no virus or other computer code or material embedded in it which may have a negative impact on the Promoter’s social media pages any network or third party computer systems
6 – If any video entry forms part of the competition, entrants acknowledge that the Promoter is solely responsible for editing the video footage to produce the final video (including all decisions as to what footage to include and video length). The Promoter’s decision in relation to any such editing is final and no correspondence will be entered into.
7 – The Promoter may (but is not obliged to) determine at any time, in its absolute discretion, whether or not to publish any entries on their social media pages, remove any entries once published on their social media pages, or amend, edit or modify any entries (or any part thereof), or disqualify or invalidate any entry including (without limitation) if the Promoter is of the view that:
(a) the entry does not comply with paragraph 6; or
(b) the entry otherwise breaches these conditions of entry.
8 – The Promoter may require the winner to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
9 – The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner whether or not legally bound by them.
10 – The Promoter’s decision is final and no correspondence will be entered into.
11 – The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
12 – Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes. Prizes will be delivered in Australia only.
13 – The Promoter may communicate or advertise this competition using Facebook, Instagram, YouTube, Tiktok and other social media platforms. The competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or YouTube. Entrants are providing their information to the Promoter and not to Facebook, Instagram or YouTube. Each entrant completely releases Facebook from any and all liability.
14 – If for any reason any aspect of this competition is not capable of running as planned for any reason, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities if required.
15 – If an entrant is required to “follow” or “like” the Promoter’s social media page, each entrant must continue to “follow” or “like” that social media page for the entire Competition Period and up until the dates of Winner Notification and Publication. Entrants who have “unfollowed” or “unliked” the Promoter’s social media page at the dates of Winner Notification and Publication will be deemed invalid.
16 – The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
17 – The Promoter collects personal information (“PI”) in order to conduct this competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.babybel.com.au/en-au/content/privacy-policy (AU). If entrants have opted in at the point of entry by ticking the opt-in box, then, in addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised by you or if a shorter period is required by applicable law, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the applicable privacy laws and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the relevant Privacy Policy).
